    I. GENERAL PROVISIONS

    1.     5. The duty of the body of internal affairs provides:

    continuous round-the-clock collection, processing and transmission of information about the operational environment;

    reception, registration of statements, reports on crimes, administrative offenses, emergency situations and incidents received on duty, as well as timely response to them;

    the continuous management of the forces and means of the internal affairs body, the immediate adoption of measures to solve crimes without delay;

    the urgent organization of actions to ensure public order, the elimination of the consequences of natural disasters and other emergencies and incidents;

    the organization of proceedings with citizens, including those arrested and delivered;

    control, within the limits of its competence, over the observance of the established procedure for keeping and escorting detainees and persons in custody;

    the safety of official documents, weapons, ammunition, special means, operational and forensic equipment, communications and other entrusted property;

    reception and safety of the seized, voluntarily surrendered, found weapons and ammunition, as well as objects and things, the identity of which is not established;

    monitoring the security of the premises, the defense of the building of the internal affairs body and the territory adjacent to it, its fire safety and sanitary condition;

    the transfer to the subordinate bodies of internal affairs of special signals on the introduction of readiness levels and the notification of personnel on them.

    6. Personal responsibility for the work of the duty unit is the head of the internal affairs body. General management of the duty units is carried out by the headquarters of the internal affairs bodies.

    10. Find out all the data establishing the presence or absence of an administrative offense, the guilt of the person delivered and other circumstances relevant to the proper resolution of the case. In the event of unreasonable detention, the person brought to the internal affairs body should be apologized. When establishing the presence of an administrative offense committed by the person delivered, actions are taken with it in accordance with the requirements of the Code of Administrative Offenses of the Russian Federation [Further - “CAO”].

    48.2. Apply in relation to the delivered person in cases stipulated by article 27.3 of the Administrative Code administrative detention, which, at the request of the detainee, relatives are notified about his whereabouts in the shortest possible time. The administration at the place of work (study) [his parents are informed about the administrative detention or other legal representatives], as well as counsel [As a defense counsel to participate in the proceedings of an administrative offense, a lawyer is allowed, the powers to are certified by an order issued by legal advice].

    A report on administrative detention is drawn up on a person who has been subjected to administrative detention, in accordance with the requirements of Article 27.4 of the Administrative Code. Detainees are detained in the prescribed manner in specially designated premises of the internal affairs bodies (rooms for detainees) or in special institutions established by the executive authorities of the constituent entities of the Russian Federation in the prescribed manner. These facilities must meet sanitary requirements and exclude the possibility of their unauthorized abandonment.

    According to Article 27.5 of the Administrative Code, the term of administrative detention is calculated from the moment the violator was brought to the duty unit to draw up an administrative protocol, and a person who is intoxicated since his sobering up, while the administrative detention of a person can last no more than three hours.

    A person in respect of which the proceedings are being conducted in the case of an administrative offense that encroaches on the established regime of the state border of the Russian Federation and the procedure for staying on the territory of the Russian Federation, an administrative offense committed in inland waters, in the territorial sea, on the continental shelf, in an exclusive economic zone of the Russian Federation, or a violation of customs regulations, if necessary, to establish identity or to clarify the circumstances An administrative offense may be subject to administrative detention for a period not exceeding 48 hours.

    A person in respect of whom an administrative violation case is being conducted, involving an administrative arrest as a measure of administrative punishment, may be subjected to administrative detention for a period not exceeding 48 hours.

    48.3. Check on the presence of data on the delinquent in the card file of persons held administratively liable for administrative offenses, as well as in other card files in the offender’s place of residence, paying particular attention to information from operational reference, investigative and forensic counts.

    48.4. If necessary, make a personal search, inspection of the things that are with the delivered person in accordance with the requirements of Article 27.7 of the Administrative Code, to draw up a protocol or make an appropriate entry in the delivery report or administrative detention report.

    48.5. To draw up a protocol on administrative offense in accordance with the requirements of Article 28.2 of the Administrative Code, about which to make a corresponding entry in column 10 of the Book of registration of persons brought to the internal affairs body.

    48.6. Report the administrative offense materials to the head of the internal affairs body for a decision.

    49. The documents withdrawn from the delivered documents and things that are the instrument or the direct object of the offense are stored in a special cabinet in the duty room along with the protocol in which the withdrawal is made, the key to the cabinet is kept by the duty duty officer. When transferring materials on an administrative offense to the person responsible for their accounting, the operative duty officer on receipt in the Accounting Book of persons brought to the internal affairs body, also transfers the seized items and documents, with the exception of weapons and ammunition.

    50. Weapons and ammunition withdrawn from the delivered ones are stored in a special metal cabinet sealed with the operational duty officer’s seal until they are handed over to an officer of the internal affairs body responsible for further proceedings in the case of this administrative offense.

    51. Withdrawal from delivered narcotic drugs and psychotropic substances, as well as their storage and transfer is carried out in accordance with the established procedure for seizure of narcotic drugs from illicit trafficking,

    psychotropic substances and their precursors, tools and equipment that are under special control and used for the production and manufacture of narcotic drugs and psychotropic substances, as well as their accounting, storage, transfer, use and destruction.

    52. If the delivered person has injuries, bodily injuries or his mental state is in doubt, as well as in the case of a statement on his part about the deterioration of his health, personal injury to himself, suicide attempt, the duty officer shall:

    52.1. Call an ambulance, before arrival of which, start providing first aid yourself, ensure that the person is constantly monitored and report the incident to the head of the internal affairs body.

    52.2. Find out the causes and circumstances of injuries and bodily injuries by a person brought to the duty unit, reflect this in the compiled report, receive a statement from him that you register with the HPUS and SP.

    52.3. Receive written explanations (report) from eyewitnesses about the circumstances of the incident in the event that the detainee caused himself injuries and attempted suicide in the premises of the internal affairs authority. Report the incident to the head of the internal affairs body.

    52.4. Decide on the further content of the person who committed the offense, depending on the opinion of the medical worker and the instructions of the head of the internal affairs body.

    53. In the event of a sudden death or suicide brought to the duty unit, the duty officer shall:

    53.1. Call an ambulance.

    53.2. Report on the incident to the head of the internal affairs body and to the duty unit of the parent internal affairs body.

    53. 3. Inform the prosecutor.

    53.4. Take measures to preserve the situation at the scene before the arrival of the person responsible for conducting the inspection.

    54. When dealing with a person suspected of committing a crime, the duty officer is obliged to:

    54.1. To conduct a personal search of a person suspected of committing a crime, and, if necessary, fingerprinting and photographing. On the production of a personal search, the use of technical equipment and the seizure of documents, valuables, money and other things to draw up a protocol in accordance with the criminal procedure legislation of the Russian Federation.

    54.2. Report on the delivery of the suspect to the head of the internal affairs body and, on his instructions, transfer materials, confiscated items, valuables and delivered to an official of the preliminary investigation or inquiry body (criminal police officer) with a note about the transfer to the internal affairs authority.

    54.3. Protect the suspect while he is on duty, excluding escape, assaulting day staff, other employees and citizens, hiding material evidence, evidence of a crime, preventing suicide, self-harm, contacts between accomplices of the crime. By written permission of the investigator (inquiry officer) to transfer the suspect clothing and other objects, with the exception of objects and things that are prohibited for storage in the ITT.

    54.4. Send the suspect for detention in the ITT upon receipt of the arrest protocol from the investigator and the investigator.

    54.5. To organize, on the written instructions of the head of the internal affairs body, deliver the person suspected of committing the crime to the internal affairs body, and immediately notify the investigator (inquiry officer), who is in charge of the criminal case, about his transfer.

    56. In the case of the delivery to the duty of foreign citizens who do not enjoy international immunity, and stateless persons, the duty duty officer conducts proceedings with them on a general basis.

    If there is information about the possible involvement of a foreign citizen or stateless person [Further - “foreign citizen”] in unlawful acts, and also if the foreign citizen is delivered without documents, or with documents that contain signs of counterfeit, an established procedure is carried out of these persons through the Interpol National Central Bureau of the Ministry of Internal Affairs of Russia.

    57. In the event that a person in a state of drug intoxication or toxicological poisoning is brought to the internal affairs bodies, the duty officer is obliged to place the person delivered to the medical facility by calling an ambulance.

    58. In the event that a person in a state of intoxication is brought to the internal affairs bodies, the said person is placed by the duty officer in a specialized medical institution or in a medical sobering center, and if they are not in the service area, in a room for detainees. After the sobering-up delivered with it, the proceedings are conducted in the prescribed manner.

    59. When dealing with a person suspected of driving while intoxicated, the duty officer must:

    59.1. Send the medical examination delivered, for which, in accordance with the requirements of Article 27.12 of the Administrative Code, draw up a protocol, a copy of which must be handed over to the delivered one. The trial of this person is carried out in the prescribed manner upon receipt of a medical examination for intoxication.

    59.2. To withdraw, in accordance with the requirements of Article 27.10 of the Administrative Code, the driver's license, delivered prior to the consideration of the material, about which to make an entry in the protocol on an administrative offense.

    59.3. To ensure the safety of the delivered vehicle and the cargo in it. If the vehicle and its cargo are not instruments of commission or direct objects of an administrative offense and do not belong to the delivered one, arrange for the owner or his representative with a power of attorney to transfer the vehicle and cargo to the last one on receipt (a copy of the power of attorney and receipt shall be attached to the case file offense).

    60. Upon delivery of a minor, the duty officer shall:

    60.1. Immediately notify the parents or other legal representatives of the minor.

    60.2. Refer a minor to conduct the proceedings:

    a) to a criminal police officer, an inquiry or preliminary investigation body, if the actions of a minor contain an element of crime, and he has reached the legal age at which criminal responsibility occurs;

    b) a juvenile affairs officer in the following cases:

    the commission by a minor of a socially dangerous act or other offense until he reaches the age at which criminal or administrative responsibility arises;

    the commission by a minor of antisocial acts or offenses entailing the application of administrative penalties;

    unauthorized care of a minor from special closed educational institutions;

    unsupervised and homeless [A neglected person is a minor who does not have control over his behavior due to the non-fulfillment or improper fulfillment of duties related to his upbringing, education, and (or) maintenance by parents or legal representatives or officials. Homeless - homeless, not having a place of residence and (or) place of stay (Federal Law No. 120-ФЗ of June 24, 1999 “On the Basics of the System for the Prevention of Neglect and Juvenile Delinquency” (Collected Legislation of the Russian Federation. 1999, No. 26, Art.     those without parental care or other legal representatives;

    lost and abandoned;

    who left the family without permission, left the educational institutions for orphans and children left without parental care, or other children's institutions;

    non-residents, places of stay and (or) means of subsistence;

    delivering a minor with a person who has committed a crime or administrative offense.

    61. Upon delivery of a minor person who is in a state of alcohol, toxicological or narcotic intoxication, having injuries (injuries), as well as signs of exacerbation of mental illness or deviation in behavior, the duty officer is obliged to:

    61.1. Call a minor ambulance for emergency medical care, before which you begin to begin to independently provide him with first aid.

    61.2. Transfer delivered to healthcare officials.

    61.3. To conduct a trial with a minor who has committed a socially dangerous act or other offense, after giving him medical assistance and having a medical opinion on his state of health.

    62. When a minor is brought in and there are no officers of the criminal police, inquiry or preliminary investigation bodies, the juvenile affairs department, the duty officer at the direction of the head of the internal affairs body is obliged to:

    62.1. To establish the data characterizing the identity of the minor, information about the parents or other legal representatives.

    62.2. Find out the circumstances of the commission of the offense or the discovery of a lost, abandoned child.

    62.3. Prepare materials necessary for referral of lost children to children in institutions of public health or specialized institutions for minors in need of social rehabilitation, and in the commission of a socially dangerous act or other offense to a minor, carry out urgent investigative and other actions in accordance with the law.

    63. At the end of the proceedings, the minor is transferred to: the parents or other legal representatives of the minor; officials of educational and training institutions;

    officials of specialized institutions for minors in need of social rehabilitation or health care institutions.

    On the transfer of a minor to a specified person, an entry is made in the register of persons brought to the internal affairs body, indicating the time of the transfer and the person to whom the minor was transferred.

    64. According to Article 22 of the Federal Law of June 24, 1999 No. 120-ФЗ “On the basis of the system for the prevention of neglect and juvenile delinquency” [Meeting of the Legislation of the Russian Federation, 1999. No. 26. Art. 3177-2001, No. 3, Art. 216] minors brought to the on-duty part of the internal affairs body may be placed in temporary isolation centers for juvenile offenders of the internal affairs bodies [hereinafter referred to as “CVINP”] in the following cases:

    unauthorized withdrawal from special educational institutions of a closed type;

    committing a socially dangerous act until the age at which the criminal responsibility for this act occurs, in cases where it is necessary to protect their life or health or to prevent them from committing a repeated socially dangerous act, and also in cases where their identity is not established or they are not have a place of residence, place of stay or do not live in the territory of the subject of the Russian Federation, where they have committed a socially dangerous act;

    committing an offense entailing administrative responsibility in cases where their identity is not established or they do not have a place of residence, place of stay or do not live in the territory of the subject of the Russian Federation where they committed the offense.

    The basis for placing a minor in the DICC is the ruling of the judge.

    At night, on weekends or holidays, or in other exceptional cases, these minors may be placed in the Center for Internal Allowances on the basis of a resolution approved by the head of the internal affairs body, his deputy or the duty officer.

    X. RESPONSIBILITIES OF THE EMERGENCY CHANGE (OPERATIONAL DUTY) FOR THE CONTROL OF THE CONTENTS, THE PROTECTION AND CONVOCATION OF THE SUSPECTED AND ACCUSED OF CRIME

    65. In the internal affairs agencies, where there are no staff duty officers of the temporary detention center and in the absence of the head of the temporary detention center in the premises of the temporary detention center, the operational duty officer establishes, releases or sends them out of the temporary detention center in the prescribed manner, placing the suspects and accused of crimes in the cells.

    66. In the internal affairs agency, where there are no full-time police escort units of the Police, the senior shift officer (operational duty officer) provides operational guidance to the officers appointed by order of the chief of the internal affairs authority to escort detainees and remand prisoners.

    67. In order to ensure reliable protection of detainees and persons in custody in the ITT, the duty officer is obliged to:

    67.6. Call an ambulance (the doctor of the nearest medical facility), if the detainee or the person in custody requested medical assistance, to provide first aid before the arrival of the medical staff.

    Xii. RESPONSIBILITIES OF THE DUTY CHANGE (OPERATIONAL DUTY) BY RECEPTION OF SERVICE INFORMATION IN THE UNITS

    72. Information of an official nature coming to the duty unit of the internal affairs body (except for statements and reports on crimes and other incidents to be registered in special books and journals) is entered in the Notebook for the records of the operational duty officer and reported to the heads of the internal affairs body.

    73. Upon receipt of a telegram, telephone message, and fax message by the duty officer of the internal affairs authority, the duty officer shall:

    73.1. Make a record on the front side of the original document on the date and time of receipt, certify it with your signature, and when receiving a fax, specify additionally where the document was received from.

    73.2. To register the received telegrams, telephone messages in the Log-book of incoming telephone telegrams, telegrams (Appendix No. 12), and the fax-logs in the Log book of received and transmitted fax-frames of the established form.

    73.3. Immediately report to the head of the internal affairs body, his deputy, which is indicated in the corresponding columns of the log of incoming telephone messages and telegrams and organize the implementation of the instructions received. In the absence of managers, the duty officer is obliged to take measures to familiarize employees of relevant departments with the signature or, depending on the content, to transfer a telegram (telegram) to the record keeping department for its subsequent delivery to the executive, and if necessary, inform the prosecutor.

    74. Telegrams, faxes on the crime committed and the search for the persons who committed the crime are stored in the duty unit of the internal affairs agency in a special folder. After the arrest of persons suspected of committing a crime, they (telegrams, faxes) are transferred to the record-keeping department for subsequent depositing into the archive.

    75. Telephone messages, telegrams, faxes sent from the on-duty part of the internal affairs body to other internal affairs bodies and subdivisions, as well as other departments, institutions and organizations are recorded in the Journal of Outgoing Telephone Telegrams, Telegrams (Appendix No. 13) and the Journal of Recording and Transmission fax images

    XVII. RESPONSIBILITIES OF THE DUTY CHANGE (OPERATIONAL

    DUTY) TO ENSURE THE ACCOUNT OF CONDEMNED PERSONS,

    ARRIVAL OR OTHER REASONS, RECEPTION AND

    REGISTRATION OF FOUND, DISPOSED, SUBJECT ITEMS AND

    94. In order to ensure the registration of convicted persons on vacation and for other reasons, the duty officer is obliged to:

    94.1. To register the person who arrived in the register of convicts who arrived on vacation and for other reasons (Appendix No. 15).

    94.2. Report on his arrival to the heads of the criminal police and public security police.

    95. When a convicted person departs to the place where the punishment is served, the duty officer shall:

    95.1. To make a note of his departure in the register of convicted arrivals on leave and for other reasons.

    95.2. Report on the departure of the convicted person to the heads of the criminal police and public security units.

    96. In order to ensure the reception and registration of the found and seized handed over items and things (vehicles, domestic animals) whose identity has not been established [Further, “items and things whose identity has not been established”], the duty officer is obliged to:

    96.1. Receive a statement and other written materials from a person who donates items and things that are not identified, upon their discovery (seizure).

    96.2. Register items and things, the ownership of which is not installed, as well as materials on the fact of their detection (removal) in the Register of found, seized, handed over items and things (vehicles, domestic animals), whose identity is not established (Appendix

    96.3. Report materials on the fact of delivery (withdrawal) of objects and things to the head of the internal affairs body.

    96.4. To transfer items and items, the ownership of which has not been established, as well as materials on the fact of their discovery (removal) to an employee of the logistical support unit of the internal affairs body, signed in the Register of found, seized, handed over items and things (vehicles, pets), whose affiliation not installed.

    XVIII. CONTROL OVER THE ACTIVITIES OF THE DUTY PART

    97. Monitoring the activities of the duty unit is intended to ensure the effective implementation of the tasks assigned to the duty shift.

    Monitoring is carried out by checking on duty duty duty, the validity of decisions made on reports and reports of crimes (incidents), the management of forces and means involved in ensuring public order and the safety of citizens, organizing visits to the SNR and SOG at the scene, the safety of weapons and ammunition , the order of maintaining books, magazines, card files and other service documentation.

    98. Head of Internal Affairs:

    by its order determines the system of control over the activities of the duty unit, the list of managers allowed to conduct inspections, and the limits of their authority;

    checks daily the readiness of the incoming shift on duty to perform service tasks, assesses the alternate alongside, paying particular attention to the timeliness, completeness of response to reports, allegations of crimes, emergencies, observance of accounting discipline, legality during the trial of the detainees and delivered;

    checks the condition of the duty room service premises, compliance with the established procedure for storing weapons, ammunition, special means, means of defense, defense, communications, operational and forensic equipment, compliance by the staff with the established procedure for informing the duty officer, and fulfilling orders and instructions given by the duty officer.

    99. The audit of the organization of the activities of the duty units of the internal affairs bodies is carried out:

    heads of the internal affairs body within their powers, determined by order of the chief of the internal affairs body;

    employees of staff and other divisions of the parent body of internal affairs within the authority specified in the order for the right to conduct an inspection of the established sample (Appendix No. 17).

    Records of the checks of the on-duty part of the internal affairs body, conducted by the heads of the internal affairs body, are made in the Duty and Surrender Book, and by the staff of the superior internal affairs body - in the Remarks and Suggestions Book of Inspectors (Appendix No. 18).

    100. At the Ministry of Internal Affairs, Central Internal Affairs Directorate, Internal Affairs Directorate, the Minister of Internal Affairs, the Chief of the Main Directorate of Internal Affairs, the Internal Affairs Directorate at least once a quarter, and in the internal affairs bodies subordinate to them, the Chief of the Internal Affairs Department sum up the work of the duty units on a monthly basis and determine the directions for their further improvement.

    Pistol and automatic cartridges of the combat kit, designed for service, must be of one year of manufacture and plant. They are stored in specially made blocks, in metal cabinets: for machine guns - separately from other cartridges and weapons, for pistols - with weapons.

    Labels with a serial number of the slot (cell) and the weapon number of the person to whom the cartridges and weapons are attached are stuck on the blocks.

    71. Bird-cherry special products, explosives and explosives are stored separately from all types of ammunition in sealed metal cabinets or boxes.

    72. The CWD also houses metal cabinets for storage of: seized, voluntarily surrendered and found weapons;

    weapons recognized as material evidence; weapons accepted for temporary preservation.

    73. In the CWC and weapons and ammunition storage sites (metal cabinets), inventories of the property and weapons stored in them are posted. In addition, lists of the names of the persons assigned to the weapons located in the storage location, its name and numbers are posted in metal cabinets.

If there are persons in the subdivision for whom a weapon with the right to permanently carry is attached to the order of the head of the internal affairs body, then an approved list of these persons or an extract from the order with the names, initials of these persons, their responsibilities, name and numbers assigned to them weapons.
